California superior court upholds DOI mandate to expand Fair Plan coverage

A California superior court has upheld a 2019 mandate from state insurance commissioner Ricardo Lara ordering the state’s insurer of last resort to expand its coverage beyond the fire and smoke damage protection it currently offers.

The DOI considers the Fair Plan’s residential policy “bare bones” and contends it forces homeowners to purchase a Difference in Conditions (DIC) policy from a private insurer to provide coverage for liability, water damage and other common perils.
